UST FEE & TAX COLLECTION CHANGES

Are you an Underground Storage Tank (UST) owner or operator? According to the recently passed House Bill 1342, the responsibility for collecting fees and taxes on USTs has now changed from the Indiana Department of Revenue (IDOR) to the Indiana Department of Environmental Management (IDEM). UST fees will now be collected by IDEM on a calendar year of January 1 through December 31.

The fee assessment information for owners, facilities, and tanks is obtained by IDEM from their UST database. This database information is gathered from the “Notification for Underground Storage Tanks” form (State Form 45223), submitted by UST owners and operators.

This past summer, IDEM requested that all UST owners and operators update their “Notification for Underground Storage Tanks” forms, as well as financial responsibility information for every active UST facility. The IDEM requires that each facility submit complete and accurate information to ensure that proper tax and fee assessments are made. The IDEM also uses this information to determine if a facility will be eligible for coverage through the Excess Liability Trust Fund (ELTF), providing financial assurance for tank owners and operators and reimbursing them for cleanup of their facilities.

If you have not updated your UST information with IDEM, you may be risking incorrect fee assessments associated with your facility. In addition, you may also experience interruptions in processing your ELTF claims associated with any releases you may have at your facility.
